1. A party may recover tort damages for intentional misrepresentation in an employment context, even though the alleged misrepresentations
would not support a breach of contract action, if the breach of duty is clearly distinct from the breach of contract. The
test is whether a relationship exists which would give rise to a legal duty without enforcement of the contract promise itself. 2. A party is liable for intentional misrepresentation if it makes a false representation of a past or present material fact
susceptible of knowledge, knowing it to be false or asserting it as one's own knowledge without knowing whether it is true
or false, intending to induce the person to whom it is made to act in reliance upon it, if such person was induced to act
or was justified in acting in reliance upon the representation, and the person suffered damage attributable to the representation.
